Sentenza Consiglio di Stato n. 3874/2013
Con il presente comunicato siamo a segnalarvi che l’impegno portato avanti dalla nostra
Associazione per far dichiarare l’incostituzionalità e l’irragionevolezza dell’Art. 38 del decreto
legge 30.09.2003, n. 269, convertito con modificazioni in Legge 24.11.2003, n. 326, in tema di
modificazione autoritativa delle prestazioni contrattuali, anche economiche, per i servizi di
custodia/deposito di veicoli fermati, sequestrati e confiscati dalle forze dell’ordine, ha conseguito
un ulteriore positivo e grande risultato.
Dopo la sentenza n. 92/2013 della Corte Costituzionale che è intervenuta dichiarando
l’Illegittimità costituzionale dei criteri liquidativi retroattivi e decurtativi, il Consiglio di Stato ha
statuito – sempre in alcuni giudizi che hanno visto la partecipazione di nostri associati e
l’assistenza dell’Associazione e dei nostri consulenti legali – che anche la cosiddetta alienazione
straordinaria in favore del custode è illegittima e non può assurgere a valido sistema con cui lo
Stato scarica le proprie responsabilità sul custode che mai ha manifestato l’intenzione di aderire
ad una tale procedura.
Anche in questo caso abbiamo mantenuto le promesse che vi avevamo fatto!
Al fine di fornire ulteriori chiarimenti, per il tramite dei nostri consulenti legali che hanno
seguito la vicenda di cui in oggetto ed altre consimili tuttora pendenti avanti altre Autorità

Infatti, in recepimento della direttiva comunitaria, il Parlamento Europeo ed il Consiglio ritengono che “il trasporto di veicoli danneggiati o da riparare” sia esentato da ogni autorizzazione di trasporto (vedi art. 1 comma 5 lettera B Regolamento (CE) n. 1072/2009 del 21.10.2009 G.U.C.E.L.300/72 del 14.11.2009).
Le motivazioni di queste scelte si riscontrano nelle considerazioni che il mezzo incidentato e bisognoso di trasporto ai fini del soccorso non deve assoggettare il trasportatore alle norme relative al trasporto classico ma a quelle del “trasporto speciale” in quanto trattasi di mezzi incidentati, non di beni di consumo o merci nuove.
